California Court Limits Where Petitioning Can Take Place

Topic Tags

California law has been settled since 1980, that large shopping malls must permit petitioning, even if that mall is private property. However, on October 5, a California State Court of Appeals ruled that when a large mall contains some very large stores with their own individual entrances, petitioning may be banned in front of those individual store entrances. The case is Vernon Van v Home Depot, B190831. It doesn’t make any difference whether the mall itself owns the property, or whether the individual store owns the property. The court differentiated bewteen the part of a mall that is used by people entering or exiting just one store, versus parts of malls that have a greater variety of usage.

One of the last true public spaces...

unfortunately the mall has become one of the few public places left to us. the supposed recognition of the mall being a semi-public place, but losing even its quasi standing of a public place when a door opens into a commercial establishment as opposed to the "mall" portion is one more failing of the concept of the public.

it is somewhat interesting that there is such a tension between malls and the commons. not only is the mall one of the few quasi public places left to us, but the "mall" as it is tied to consumerism is also one of the few effectual means we have left for flexing our political muscle. namely the boycott. political participation has become, to a large extend, where we choose to spend our money.

Publica!

The only thing public is the library--and that's bascially a spot for the shelter impaired to kick it for 8 hours..soooo, post no bills. Spread your Commi views through the internet or in some local, indie rag like everyone else.

where the people are

the liberry is perhaps the only true public place, but you have to go where the people are. unfortunately the liberry is not as frequented as it once was. although, i am alway surprised how many people actually go to the liberry. just a guess, but i would imagine that more people go to river park in one day than the liberry system in a year. unfortunately the mall is the town square, but not very public, less so than it used to be, apparently.

LIBRARY--SAY IT RIGHT GILBERT GRAPE

Listen, A-Hole, it's L-I-B-R-A-R-Y, it isn't a gaddamn fruit. Liberry? really? is that how you say it--I hear this all the fu@#ing time. Even if it was liberry, fruit can't lie, cuz fruit can't talk. You make me ill.

you must be liberian

you and i both know that it is more often than not referred to as a liberry. i was once listing to a radio show about liberries and the liberian referred to the place she worked as a liberry. it was a half hour show as well. i figure a liberian must know best.

liberry

I heard that radio show too, and I remember the Liberrian. I think that term refers to someone who only eats liberries. I think that's way certain posers refer to themselves as "media specialists," so they're not mistakenly associated with people of weirdo dietary persuasions.

A Rose By Any Other Name Wouldn't Be A Goddamn Rose

Listen, I'll tell you all what the correct title is and how you should address a LIBRARIAN when you see one on the streets:

Resource Print & Non-print Multi-Media Expert Genius Fact-Finding Crucial Information Facilitator of Aesthetics and Logical Moral Ethics Literary Word Wizard or... R.P.N.M.E.G.FF.C.I.F.A.L.M.E.L.W2--for short.

so get it right already and spread your socialist mumbo jargon somewhere it's wanted...like Selma.

Duck Soup

So you have FF for the hyphenated "Fact-Finding," but only "N." for the hyphenated "Non-print?" What gives? I figured I'd ask you since you're a R.P.N.M.E.G.FF.C.I.F.A.L.M.E.L.W2. I'm not a R.P.N.M.E.G.FF.C.I.F.A.L.M.E.L.W2 so I'm at a huge disadvantage. I'm sure there is some R.P.N.M.E.G.FF.C.I.F.A.L.M.E.L.W2 reason for this but I don't know it.
